SkyPrivate is entitled to permanently close multiple accounts without previous notification.

4.8. If you are accessing our products through Third Party providers, we are not responsible, or liable for the content, modifications or technical accuracy of those products. Your use of these Third Party products is subject to their terms of use.

5. Fees, Credit Compensation, Refund and Unlawful Conduct

5.11. Only full purchased packages can be refunded. 5.14. Under no circumstances, including, but not limited to, negligence, shall skyprivate.com or any of its related, affiliated companies be liable for any direct, indirect, incidental, special, consequential or punitive damages that result from the use of, or the inability to use the service, without prejudice of the established in the present clause.

5.15. Cases of dishonest behavior related to online transactions are handled with high priority keeping, however, in mind the subscriber privacy. Such cases may be outsourced to companies specialized in this field.

5.16. In case of any fraudulent transaction, SkyPrivate reserves the right to use all available information at its disposal during any kind of legal procedure. Including, without the claim of completeness, browser history, IP and email addresses and any other traceable activity. 5.17. SkyPrivate grants full cooperation to legal authorities investigating fraudulent transactions and other matters falling under legal jurisdiction and responds to subpoenas and court orders.

5.24. In the specific situation where a user recommends himself/herself as a member of the SkyPrivate team and using this status provides false information to other users, under a false identity, SkyPrivate reserves the right to make further investigations of his identity and to make decisions consequently. 4.6. The present agreement shall be effective as of the date hereof and shall remain in force until duly terminated by either party in full compliance with the terms and conditions expressly set forth in this Agreement.

4.7. On SkyPrivate there are two different type of subscription: member and ASP (model). One type of subscription excludes the other (one subscriber is allowed to subscribe only one type of service: member or ASP). Also, it is forbidden for one subscriber to have multiple accounts, regardless of their type (exceptions are allowed for ASP accounts only with skyprivate.com consent). SkyPrivate is entitled to permanently close multiple accounts without previous notification.

4.8. If you are accessing our products through Third Party providers, we are not responsible, or liable for the content, modifications or technical accuracy of those products. Your use of these Third Party products is subject to their terms of use.

In case you receive errors while accessing the product through Third Party providers, you understand and agree that we will not be held responsible for this and that your use of these Third Party products is subject to their terms of use.

5. Fees, Credit Compensation, Refund and Unlawful Conduct

5.1. The subscriber may load his account with an amount that can be spent as “pay-per-minute” or “direct payment” in the available areas of Adult Entertainment; therefore the selection of services must be preceded by the consultation of the Subscriber of the correspondent content, price list, and means of payment made available on the website – https://www.skyprivate.com.

5.2. If the subscriber wants to access the full feature, he/she must click on “Call Skype” button and from that point on stays in the video chat with the Adult Service Provider (ASP) entering into a private mode where the funds are used on a pay per minute basis.

5.7. SkyPrivate will not take responsibility for any difficulty occurring outside SkyPrivate.

5.8. Any complaint must be placed, within 72 hours counted from the occurrence, at SkyPrivate – Support Service. Given the complexity and particularities of the procedure to determine the righteousness of the complaints placed after the referred 72 hours period, these shall only be acknowledged in cases of force majeure.

5.9. SkyPrivateCustomer Service team may whenever deemed necessary, carefully investigate reports and other data at its disposal, resorting to any existing means for such effect

5.10. SkyPrivate will only compensate/refund credits in the amount proportionally determined in accordance to the price paid and problem effectively reported when any credit is lost due to dysfunction of SkyPrivate or an Adult Service Provider (ASP) in the Nude Only part of the site totally and explicitly refuses to provide erotic content. In case some erotic content is provided, SkyPrivate will assess the situation and discretionarily decide whether any compensation/refund of credits is due.

5.11. Only full purchased packages can be refunded. In the event that a transaction is refunded, the correspondent amount (determined in accordance to the foreseen in point 5.6 above) will be credited in the credit card that was used to make the original purchase, being deducted from the SkyPrivate Credit Balance. The transactions older than 2 months cannot be refunded.

5.13. Notwithstanding the referred in the previous numbers, SkyPrivate will not be liable for any defamatory, offensive or illegal conduct of any subscriber, or for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of or use of records, whether under contract or tort theory, or under any other cause of action, for any amount over and above the amount paid by the subscriber to SkyPrivate.

5.14. Under no circumstances, including, but not limited to, negligence, shall skyprivate.com or any of its related, affiliated companies be liable for any direct, indirect, incidental, special, consequential or punitive damages that result from the use of, or the inability to use the service, without prejudice of the established in the present clause.

5.15. Cases of dishonest behavior related to online transactions are handled with high priority keeping, however, in mind the subscriber privacy. Such cases may be outsourced to companies specialized in this field.

5.16. In case of any fraudulent transaction, SkyPrivate reserves the right to use all available information at its disposal during any kind of legal procedure. Including, without the claim of completeness, browser history, IP and email addresses and any other traceable activity. During such legal procedures, skyprivate.com might involve other, professional investigator parties and share certain information in order to comply with federal law, vindicate its rights and represent the best interests of its Customers.

5.17. SkyPrivate grants full cooperation to legal authorities investigating fraudulent transactions and other matters falling under legal jurisdiction and responds to subpoenas and court orders.

5.18. Please take into consideration that SkyPrivate reserves the right to round payments to be paid as a compensation/refund, and therefore, SkyPrivate shall be entitled to apply rounding.

5.19. Members have up to 72h to report issues encountered in conversations with models. If they exceed this period, their reports will no longer be taken into consideration.

5.20. Members or ASP’s will be able to upload screenshots evidence or comments to the report investigation until this one is closed. The users won’t be able to submit more information after the closure of the case.

5.21. If a Studio or ASP’s account is suspended or terminated for any reasons, any upcoming withdrawals will be put on hold until all reports will be solved and it will be reviewed in a month’s time from the day it was suspended.

5.23. When users with malicious intentions are paying suspiciously considerable amounts to ASPs, or when ASPs have been detected to cooperate with fraudulent users these transactions can be charged back. ASPs are expected to report any suspicious activity.

5.24. In the specific situation where a user recommends himself/herself as a member of the SkyPrivate team and using this status provides false information to other users, under a false identity, SkyPrivate reserves the right to make further investigations of his identity and to make decisions consequently. SkyPrivate reserves the right to suspend the user’s activity, to notify users of his / her negative behaviour and to withhold any possible payments for this user indefinitely.

5.25. If a model is registered under a Studio, the studio is solely responsible for the payments made to the model according to their agreement. SkyPrivate will not take responsibility for any situation occurring between the model and the studio regarding payments.

5.26. The model/ studio owner must be the owner of the account or wallet (account or wallet must be in their name and belong to them ) they use to receive payments from SkyPrivate.

6.Subscriber Declarations

12.3. If any portion of this Agreement is deemed unenforceable by a Court of competent jurisdiction, it shall not affect the enforceability of the other portions of this Agreement.

12.4. The prevailing party in any suit to enforce the terms hereof shall be entitled to recover his/her/its reasonable attorneys’ fees.

12.5. This Agreement may be modified by skyprivate.com, being the said modifications posted on the website. The subscribers must periodically check if any modifications have been posted and in case of non-acceptance of said modifications, the subscribers may, immediately, proceed with the cancellation of their subscription, within the terms established in the present Agreement.

12.6. The English version shall prevail of all legal statements, statutory declarations made by SkyPrivate, including the present Agreement. SkyPrivate does not accept any kind of legal claims or other complaints about the misunderstandings as a result of any mistranslation.

12.7. This agreement enters under Common Law jurisdiction.
